Conditions of Entry for the Melodique Vocals Awards
CONDITIONS OF ENTRY The competition known as THE MELODIQUE VOCAL AWARDS is organised and promoted by MELODIQUE (the “The Producer”). In return for registering to participate in THE MELODIQUE VOCAL AWARDS I agree to the terms and conditions as follows: 1 The registration form must be completed in full and all personal details and/or information given in my application either in this form or otherwise must be truthful, accurate and in no way misleading. I undertake to inform the Producer immediately if any such information becomes inaccurate. 2 The registration fee of $35.00 must be paid to complete registration. 3 The competition may be held in an outdoor space and may be subject to reschedule depending on weather conditions and the discernment of the Producer, even as late as the day of competition. If it is in fact rescheduled the greatest effort will be made to establish a new time and date to suit all competitors, however if the competitor is unable to attend the new date/times there will be no refunds; 4 There are no refunds allowed under any circumstances, except if the competition is cancelled for reasons unforeseen, or the Producer chooses to not include the applicant; 5 The Producer reserves the right to choose who takes part in the Competition based on the online application. Contestants will be notified via email or phone should their application be successful. 6 The songs I wish to sing must be selected upon registration, I must select 2 songs in total, 1 song must be up-tempo and each song must be no more than 4 minutes in length. It is possible that only 1 song per competitor may be allowed to be sung on the day due to time constraints, and it is up to the discretion of the Producer which song/s are used in the competition; 7 All music genres will be accepted in the Competition including, but not limited to; Pop, R & B, Country, Musical Theatre, Classical and Rock; 8 The Competition will only allow solo vocalists; 9 The competitors may perform to a backing track, accompany themselves or have an accompanist. Only the performance of the soloist will be judged (however, bear in mind that the quality of the accompaniment can affect the quality of his/her performance). 10 Competitors must provide all backing tracks prior to the day of the Competition via the internet and on the day of the event on CD or USB only. Competitors can use mp3, wav or m4a formats – however, no video files will be allowed. 11 The Producer reserves the right to ensure and discern that all songs selected by Competitors are age appropriate, lyrically appropriate and, do not contain any swear words and/or inappropriate language and failure to select a song that meets these standards will result in disqualification from the Competition; 12 The Producer reserves the right to ensure and discern that all attire and costume worn for the Competition is appropriate to the Competition and failure to meet these standards will result in disqualification from the Competition; 13 Any behaviour such as poor sportsmanship, swearing, name-calling, bullying or unacceptable behaviour of any kind towards any persons involved in the Competition will not be tolerated and the Producer reserves the right to disqualify any competitor who does not comply. In addition, any member of the audience who behaves in this manner will be asked to leave the vicinity of the Competition; 14 Competitors that do not attend the competition and/or do not register their attendance on the day of the Competition at the correct time (which will be advised by email at later date post registration) will not be entitled to perform on the day and will be disqualified from the Competition; 15 The minimum age for participation in the Competition is 10 years of age and anyone under 10 years of age will not be permitted to compete in the Competition and, children between the ages of 10 and under 18 years of age must be accompanied by an adult and the registration form and permission form provided must be completed and signed by a parent/guardian; 16 The Producer reserves the right to add/reduce the number of heats/finals/contestants/acts in accordance with the Competition numbers; 17 Additional prizes and categories may be added at the Producer’s discretion; 18 I acknowledge and agree that this is not a public event and that any audience member must purchase a ticket to attend. 19 The Judges’ decision will be in the interests of the Competition and will be final in all respects; 20 I agree to indemnify the Producer, its appointed agents, sponsors, venue and property owners and their representatives in respect of all actions, proceedings, claims, damages and other liabilities which may be brought against or incurred by the Producer, its appointed agents, sponsors, venue and property owners as a result of the breach of any of my warranties, representations or obligations contained in this agreement. 21 I acknowledge and agree to abide fully by the rules, regulations, terms and conditions for the Competition. I agree to observe all procedures and obey all reasonable instructions in force or given by a member of the Producer and/or any location staff in connection with the Competition and the management of the locations and the fire safety and security arrangements in those locations. 22 I acknowledge that the Producer reserves the right to amend these Terms and Conditions (including without limitation verbally) or terminate the Competition at any time without liability to me. The Producer’s decisions shall be final. 23 By participating in the Competition I agree that my song submission/s being used (in full or part) throughout the Competition by the Producer can be used for promotional and associated advertisements. 24 The Terms and Conditions of the Competition are governed by the laws of the State of New South Wales. 25 If any term in this agreement is held by a Court to be void or unenforceable such term shall no way affect any other provision in this agreement, the application of the provision in any other circumstances or the validity or enforceability of this agreement and such provision shall be curtailed and limited only to the extent necessary to bring it within legal requirement.
